1. Introduction

Unix-Solutions BV (Hoge Wei 37, 1930 Zaventem, Belgium; company number BE0894.307.633), ("Unix-Solutions", "we", "us"), is committed to protecting your privacy and handling personal data in an open and transparent manner.

This Privacy Policy explains how we process personal data when providing services to customers, when conducting customer acquisition and prospect scouting activities, and when you visit our websites (unix-solutions.be, datacenters.unix-solutions.be) (together the Sites). It also describes your rights and how to exercise them.

2. Who is responsible for your data?

For the services we provide to our customers (e.g. colocation, cloud hosting, connectivity), the customer remains the data controller, and Unix-Solutions acts as data processor. For personal data collected on our Sites and for our own marketing and business operations, Unix-Solutions BV is the data controller.

4. What personal data do we collect?

We process different categories of personal data depending on whether you are a customer, customer contact person or website visitor:

Name, job title, company, professional contact details (email, phone number), communication history (e.g. emails, calls, event participation), and any other information you voluntarily provide through contact forms, networking, or marketing interactions. Such data may be obtained directly from you, from publicly available business sources (e.g. LinkedIn, company websites), or from trusted third parties providing B2B lead information.
Customers and their representatives Name, job title, company name, contact details (email, phone number, billing address), VAT number, billing and payment information, service order history, support ticket history, SLA-related communications, system/account login credentials (portal access), and any other information provided in the context of service delivery or contract management.
Datacenter visitors Name, company name, government-issued ID or passport number (for identity verification on entry), vehicle registration if applicable, date/time of visit, purpose of visit, escorted access logs, and CCTV images recorded within the facility.
Website visitors IP address, device and browser information, pages visited, cookies and similar identifiers. Most data is processed by automated means to enable the functioning of the website. Where relevant, these datapoints are collected and processed into an aggregated view. We do not individualize visitors.

We do not intentionally collect special categories of personal data unless explicitly agreed with customers and subject to additional safeguards.

5. How do we collect your data?

  • When you provide it to us (e.g. filling out a contact form, signing a contract, registering for an event).
  • Through our services (e.g. generating access logs, monitoring service usage).
  • Through automated technologies on our Sites, such as cookies, web beacons and server logs (see Cookies below).
  • From third parties, including:
    • Credit agencies or business partners;
    • Law enforcement, police or government agencies when they share data with us in the context of legitimate investigations, legal obligations, or regulatory inquiries.
    • Third-party data enrichment or verification services, which may provide business-to-business information (e.g. validation of company directors, beneficial owners or business representatives) for purposes such as due diligence, fraud prevention and compliance checks.

6. Purposes and legal bases for processing

We process personal data only when we have a lawful basis under the GDPR. The table below summarizes the purposes and legal bases:

Marketing communications Consent (Art. 6(1)(a)) or Legitimate interests With your consent, we may send you newsletters or marketing communications about our products and services. You may withdraw your consent at any time (see Your rights). Where we rely on legitimate interests to send business-to-business communications, we balance our interests with your rights and provide an opt-out in each message.
Analytics and improvement of our Sites Consent (for non-essential cookies) We use Google Analytics to understand how visitors use our Sites, to improve our content, and, where you have provided your consent, for remarketing purposes. This may include displaying relevant Unix-Solutions advertisements on other websites based on your prior interactions with our Sites. Analytics and remarketing cookies are only used with your prior consent (see Cookies).

If we plan to use your personal data for a new purpose not covered by this notice, we will update this Policy and, where required, request your consent before the new processing begins.

7. Recipients of personal data

We may share personal data with law enforcement, police or government agencies when we are legally required to provide personal data in the context of an investigation or regulatory inquiry. We only disclose such data when a valid warrant, court order, or other lawful request is presented.

We do not sell personal data to third parties.

8. International transfers

Unix-Solutions strives to store and process personal data within the European Economic Area. If we transfer personal data to a recipient in a country outside the EEA that does not provide an adequate level of data protection, we implement appropriate safeguards, such as EU Standard Contractual Clauses or an adequacy decision. You can obtain a copy of the safeguards by contacting us.

9. Retention

We keep personal data only as long as necessary for the purposes described in this Policy:

  • Personal data B2B prospect data: retained for as long as we have a legitimate commercial interest in maintaining contact.
  • Customer and billing data: kept for the duration of the contract as long as necessary to comply with accounting and legal obligations.
  • Access logs and technical data: generally retained for 5 years for security and operational purposes unless legal obligations require longer retention.
  • Marketing data: retained until you withdraw your consent or object to further processing.
  • Physical badge access data: generally retained for 5 years.
  • Datacenter visitor identification data: retained for generally retained for 5 years unless a security incident requires longer retention.

When the retention period ends, data are securely deleted, anonymized or put beyond use.

10. Your rights

As a Data Subject, you have the following rights under the GDPR:

  • Right of access - obtain confirmation as to whether we process your personal data and request a copy.
  • Right to rectification - request correction of inaccurate or incomplete data.
  • Right to erasure - request deletion of your data when it is no longer needed, when you withdraw consent or object to processing, or when processing is unlawful.
  • Right to restrict processing - request us to restrict processing under certain conditions (e.g. when you contest accuracy).
  • Right to data portability - receive your personal data in a structured, commonly used and machine-readable format and transmit it to another controller.
  • Right to object - object to processing based on our legitimate interests or to direct marketing.
  • Right to withdraw consent - when processing is based on consent, you may withdraw it at any time without affecting the lawfulness of processing before withdrawal.
  • Right not to be subject to automated decision-making - you have the right not to be subject to decisions based solely on automated processing, including profiling, that produces legal effects or significantly affects you, unless authorized by law or based on your explicit consent. Unix-Solutions does not currently carry out such automated decision-making.

You also have the right to lodge a complaint with the Belgian Data Protection Authority (contact details available at www.dataprotectionauthority.be).

11. Cookies and similar technologies

We use cookies and similar technologies on our Sites. Cookies are small text files placed on your device to enable site functionality and measure performance. We categorize our cookies as follows:

We obtain your consent for non-essential cookies via a cookie banner. You can choose which categories of cookies to accept or reject and can withdraw your consent at any time by adjusting the settings in the cookie banner or by deleting cookies through your browser settings. Our privacy policy, accessible via the banner and the footer of each page, provides detailed information about each cookie, its provider, purpose and lifespan.

Consent is not a condition for accessing our Sites; if you refuse cookies, our Sites will still operate but some features may not be available.

12. Security

We take the security of your personal data seriously and have implemented physical, technical and organizational measures to protect against unauthorized or unlawful processing and against accidental loss, destruction or damage. Measures include access controls, encryption, intrusion detection, network segmentation, regular security reviews and ISO 27001 certification. We regularly assess the effectiveness of our measures and update them as needed.

13. Providing data and consequences of refusal

When we collect data to enter into, or perform, a contract with you (e.g. service subscription), providing such data is necessary; if you do not provide it, we may not be able to offer the Services. In other situations (e.g. marketing), providing personal data is voluntary, and you can decline without affecting our contractual relationship.

14. Changes to this Policy

We may update this Policy from time to time to reflect changes in our practices or legal requirements. We will post the updated version on our Sites and indicate the revision date. If changes are material, we will provide a prominent notice and, where required, request your consent before implementing them.
